What is Mediation?
Mediation is a process for solving problems and resolving disputes without using Court involvement, during which a trained, neutral mediator facilitates communication, encourages the parties to explore options and alternatives, and helps the parties work toward agreements using good faith bargaining. The mediator is not a decision maker. The parties retain the sole power to agree (or not agree). All participants, including the mediator, sign a confidentiality agreement stating that any matter discussed in mediation will not be disclosed in any court of law. The mediator does not represent either party and does not give legal advice to any party.
Family Law Mediation
Family law mediation most often involves issues of child custody and visitation disputes wherein the parties themselves ultimately determine the particular settlement terms relating to the children since the lawyers are not directly involved in the mediation process.
Major Civil Case Mediation
Unlike family law mediation, major civil case mediation involves all named parties, attorneys and others who will take an active role in settlement, such as an insurance company representative, and who must be present or otherwise available for the mediation sessions.
